Likewise, the website offers users the possibility of contracting services of discretionary transport of travelers by road with the company BETANCURIA TOURS SL, (hereinafter Provider or Supplier), limiting the function of tuVenFUE to a simple intermediation, facilitating the relationship between the aforementioned provider and the user or traveler. Additionally, the website sells experiences, intermediating with the reservation center of third-party companies that will be responsible for addressing any questions that arise in relation to them.

FIRST.- GENERAL OBLIGATIONS OF THE USER

The USER undertakes:

1. Read and Accept the General Conditions of Contract and Use of this Website, as well as the specific conditions that may be established in your case.

8. It will be understood that the user is subject to the contract established by the Provider from the moment they make a reservation. The online acquisition of any transport ticket implies the acceptance of the general conditions of purchase, as well as the express, full and unreserved acceptance of all the general conditions of purchase published by Betancuria Tours S.L.

TuVenFUE will not be liable for breaches that are not directly attributable to it, nor for those produced by unforeseeable circumstances, force majeure, or by meeting legal or administrative requirements. In the same way, it is not responsible for the loss of link of its intermodal services with other transport, its own or others. Notwithstanding the foregoing, to those travelers who wish to link the contracted service with an air transport service and given that the provider's services run on a pre-established itinerary that cannot be varied due to adverse traffic circumstances unless expressly instructed by the competent authorities, It is recommended that you purchase tickets sufficiently in advance to take into account the recommendations on presentation time at airports for national or international flights made by AENA or the airline in question in each case. Claims for compensation for death or personal injury caused during the provision of the service must be referred to the Service Provider. The responsibility of tuVenFUE is restricted to providing on the Web information about the services available to make the reservation and manage it with the provider.

Likewise, tuVenFUE has services in its vehicles to attend to people with special needs, disabled travelers, the elderly or people with reduced mobility.

SECOND.- TICKETS

TuVenFUE will sell tickets solely and exclusively on the Web. The tickets purchased are nominative, and the bearer must justify their ownership by means of a DNI or Passport to access the vehicle.

It is the responsibility of the user to check the ticket data at the time of purchase, that the printed data (route, date and time) coincide with those requested.

Tickets that present amendments, deletions, or deterioration that prevent the proper identification of the route, date, time and / or identification of the user will not be accepted.

The change, modification, cancellation or cancellation of tickets is not allowed.

The non-presentation of the traveler at the place and time of departure will lead to the loss of the trip and will not give the right to exchange the ticket or refund it.

THIRD.- PASSENGER TRANSPORTATION

The passenger will be able to access the vehicle after showing the ticket to the driver.

The effective provision of the service will be carried out by the company BETANCURIA TOURS S.L., so it will be the entity responsible for the development of the service.

Travelers in a wheelchair, with reduced mobility or spatial needs have at their disposal special seats (PRMR) to travel seated in their own wheelchair. These seats have the same cost as the rest of the vehicle seats. If the traveler wishes to travel in a conventional seat on the bus, he can take his chair in the trunk at no additional cost. In this case, they must be able to get into the vehicle and settle into the seat autonomously. In the event that the traveler is within the circumstances described in this paragraph, they must check the box enabled for this purpose on the ticket sales web platform.

Likewise, children from one year of age are considered occupying a place and therefore are subject to the established price list. The mandatory restraint devices approved according to the weight and size of the child who must use them (chairs or boosters) are free, although they must be previously specified on the website at the time of booking.

In turn, article 11 of the General Traffic Regulation prohibits the transport in the passenger compartment of any animal, except those of psychological accompaniment, assistance and guide dogs, in addition to those correspondingly prescribed with the accreditation of the certificate that justifies it, and always under the responsibility and accompanied by their owners.

FOURTH.- ECONOMIC CONDITIONS

TuVenFUE will unilaterally establish the price of the services that appear on the Web Portal for online sale, and may vary them at any time.

The prices on this Website are shown in Euros.

TuVenFUE will only accept payments made through Visa, Visa Electron, MasterCard and American Expres credit or debit cards.

In the event that the payment method chosen by the client is a credit or debit card, the charge will be made in real time, through the payment gateway of the corresponding financial institution, once it has been verified that the data communicated is correct.

TuVenFUE uses secure payment systems from leading financial institutions in electronic commerce. In this sense, the confidential data of the payment are transmitted directly and in an encrypted form (SSL) to the corresponding financial institution. For payment with Visa, MasterCard and American Express cards, tuVenFUE only accepts CES (Secure Electronic Commerce) transactions including, if applicable, the international 3D Secure protocol distinguished by the Verified by Visa, MasterCard SecureCode and American Express Safekey badges. Secure Electronic Commerce is an initiative whose basic principle is to guarantee security in Internet transactions. FIFTH.- LUGGAGE

The traveler has the right to free transport, in the hold of the bus, of a suitcase with a maximum approximate weight of 20 kg. Likewise, they have the right to transport, in the luggage tray of the coach, a hand luggage with approximate dimensions of 45cmx35cmx20cm .

All luggage must be properly labeled with the owner's name and destination address. Any excess baggage must be declared at the time of booking the ticket on the online sales platform. We also reserve the right to refuse to carry excess baggage.

Since you formalize the contract for its processing with the Provider, you should refer to the latter the queries or matters related to your service. If you have any problems during your trip, you must inform the Supplier.

You must take responsibility for your luggage and transport it assuming the risk. Neither we nor your Provider will assume any responsibility for loss or damage to it. We advise you to take out adequate travel insurance that offers coverage against such eventualities.

SIX.- SPECIAL LUGGAGE

The transport of surfboards, bicycles, and any other similar element of sports and / or leisure equipment and accessories, which due to their dimensions and / or characteristics must be located in the hold of the bus, has a supplement added to the price of the ticket that will be detailed in the online sales website. These items must be able to travel without causing damage to other luggage or packages, being mandatory that they be packed in some type of box or bag prepared for transport. The transport of this type of heavy material must be previously marked in the box provided for this purpose on the Web at the time of ticket purchase.

SEVENTH.- RIGHT OF ADMISSION

The Supplier, our representative or the driver of the vehicle reserve the right to refuse to transfer anyone who is under the influence of alcohol, drugs or whose behavior may be considered dangerous for the driver or other passengers, including you. In this case, no refunds will be made or any liability will be assumed for the provision of the service, neither to you nor to anyone traveling with you, nor will alternative solutions be proposed.

The consumption of alcohol, narcotic substances or tobacco is not allowed inside any vehicle.

EIGHTH.- CLAIMS

Since you formalize the contract for its processing with the Provider, you must refer to the latter the queries or matters related to your service. If you have any problems during your trip, you must inform the Supplier. NINTH.- LANGUAGES

Our web pages are available in several languages. Our customer service and email assistance services are available in Spanish and English, although we will try to provide them in the language in which it is contracted.

We monitor the quality of the translation of our web pages and of our terms and conditions. In the event of any discrepancy, the Spanish version will prevail.

TENTH.- MISCELLANEOUS

Notifications: Any notification that must be made between the parties as a result of the same will be made by ordinary mail, fax or email in the means indicated for that purpose in the legal notice. 

Modification: tuVenFUE may modify these conditions at any time.

Withdrawal: In accordance with article 93 k) of Royal Legislative Decree 1/2007, which approves the Consolidated Text of the General Law for the Defense of Consumers and Users, the regulation of distance sales (with the exception of article 98.2 ) is not applicable to passenger transport service contracts. For this reason, the right of withdrawal does not apply to reservations of transport services for people. In this way, in the event that the user expresses his willingness to cancel the contracted tickets, the cancellation conditions regulated in this document will apply.

Smoking Ban: - It is absolutely forbidden to smoke in the vehicle (Art. 6 R.D. 1293/1999).

Lost Objects: Any perishable product that remains in the vehicle after the service will be deposited in the corresponding garbage container, and cannot be claimed by the customer.

Complaints Book: There is a complaint book in all vehicles available to its users. In accordance with the provisions of current regulations, the claim must be submitted within three months from the date on which the regular service was provided or should have been provided. In the month following receipt of the claim, the Provider must notify the traveler that their claim has been admitted, has been rejected or is still being examined. The deadline to provide the definitive answer will not exceed three months from the date of receipt of the claim.

Data protection: Both parties affirm that they meet all the guarantees for compliance with European and Spanish Data Protection regulations. The user agrees not to disclose the information and documentation that is classified as confidential by the parties, taking the appropriate measures to achieve this purpose, not keeping a copy of said information once the contractual relationship has ended. TuvenFue expressly refers to its data protection policy.

Full contract: The annexes included in the contract are part of the contract and will be considered part of it.

Survival of the contract: If any provision of this document is legally invalid or unenforceable, for whatever reason, said validity or unenforceability will not affect the rest of this document, which will remain fully subsistent. The parties, by mutual agreement, will replace invalid or unenforceable clauses with valid clauses, the content and spirit of which is, as far as possible, equivalent or similar to those to be replaced.

Applicable Law and forum: The applicable Law is Spanish. The Courts of the city of Puerto del Rosario, when the recipient is a businessman or professional, will be competent to hear any litigation, conflict in the interpretation or breach of the clauses of this contract, if they were different. . In any case, in the case of a consumer, the forum stipulated in Royal Legislative Decree 1/2007, of November 16, which approves the revised text of the General Law for the Defense of Consumers and Users, will be applied.

SPECIAL CONDITIONS FOR COVID-19

USE OF A MASK: The use of a mask is mandatory in all types of public transport, under the terms, conditions and exceptions established by current legislation.

SAFETY DISTANCE: Keep the safety distance of 1.5 meters during boarding and disembarking.

RECOMMENDATIONS DURING THE TRIP:
